Important Rules to Know about Gay Marriage

handstogether08-06-15It’s almost time! As of tomorrow at 5:01pm, same sex couples will FINALLY be allowed to be legally married in California. So, some of you may want to know… What are the new rules for gay marriage? What do they say at the marriage? When, how, where, can same sex couples get married? Have no fear. Here is a list of ten of the most commonly asked questions of gay marriage.

  1. The marriage commissioner will now say: “By virtue of the authority vested in me, as a Deputy Commissioner of Marriages for the County of XXX, I now pronounce this couple united in marriage under the laws of the state of California.”
  2. If you’ve had a civil union in another state you are considered unmarried and therefore you can now get married in California now.
  3. There is no waiting period between when you get the marriage license and when you get married.
  4. 5:01 p.m. Monday, June 16th, is the earliest gay couples will be allowed to get married. San Francisco and Los Angeles counties will issue one marriage license each Monday night to a designated couple to commemorate the ruling.
  5. If you are a member of the military, marrying or attempting to marry a person of the same sex is grounds for dismissal from the service. Apparently you can fight for your country, but not marry who you want. Who knew!
  6. A state Supreme Court HAS overturned a constitutional amendment approved by voted before in Colorado. In 1992 voters approved Amendment 2, which would have overturned local laws protecting gay men and lesbians from discrimination on the basis of their sexual orientation. The Colorado Supreme Court ruled the amendment unconstitutional, as did the U.S. Supreme Court, which said in 1996 that it violated the U.S. Constitution’s equal protection clause.
  7. If you and your partner are already married, there is no need to register out-of-state or foreign marriages with California authorities. As of 5:01 p.m. June 16, California will automatically recognize same-sex marriages performed legally elsewhere.
  8. If you are already married, your cannot re-marry! You’re already married!
  9. You may come to California and get married if you are not from California, and Massachusetts and New York state will recognize the marriages. Other states may not recognize the marriages, and some, including Wisconsin and Delaware, impose criminal penalties on its residents “if they enter a marriage outside the state that would have been prohibited in the state,” such as gay marriage.
  10. Robin Tyler and Diane Olson will be the first gay couple to be legally married in Los Angeles County!

Here’s the process for counties in Southern California:

  • Los Angeles County: No appointment is needed to apply for a marriage license. Wedding ceremonies at the county clerk’s office in Norwalk are on a first come, first served basis only on Tuesday and June 21; appointments are required at all other times and locations. It costs $70 for the license and $25 for the ceremony. Starting on Monday at 5 p.m., applicants can begin to fill out the application online, but must come into a clerk’s office to receive the license.
  • Orange County: Appointments are accepted but not required. The license costs $61.50, and the ceremony $28; debit cards are also accepted. Those who start their application online before arriving at the clerk’s office are given priority.
  • Ventura County: Appointments recommended but walk-ins are allowed. The license costs $97, the ceremony $45, and the certificate, once the wedding is completed, is $13. You may start the marriage application here and go to the right-hand corner, and click on the “marriage application” tab.
  • San Bernardino County: Appointments recommended, but walk-ins are permitted. The certificate costs $73; the ceremony costs $40; each fee will rise $10 on July 1. Here’s a handy information sheet.
  • Riverside County: Appointments are required; call (951) 486-7000 to schedule one. The license costs $68 and the ceremony costs $40. Applicants can print out the application here.
